1. Acceptance of Terms

By accessing or using the DataChill platform, including our website, mobile applications, and related services (collectively, the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

3. Account Registration

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Services

DataChill provides a platform for purchasing airtime, data bundles, electricity tokens, cable TV subscriptions, broadband services, and managing a digital wallet. We act as an intermediary between you and the relevant service providers.

All transactions are subject to availability, network connectivity, and the terms imposed by the underlying service providers. We do not guarantee uninterrupted or error-free service.

5. Wallet and Payments

The DataChill wallet allows you to store funds for use within the Service. You may fund your wallet through supported payment methods. Funds in your wallet are non-transferable and do not earn interest.

All transactions are final once confirmed unless otherwise required by applicable law. It is your responsibility to verify transaction details before confirming any payment.

6. Fees and Charges

We may charge fees for certain transactions or services. Any applicable fees will be displayed before you confirm a transaction. We reserve the right to modify our fee structure at any time, with reasonable notice provided through the Service.

7. Refund Policy

If a transaction fails and your account is debited, the amount will be refunded to your DataChill wallet. For card payments that fail after payment has been processed, refunds will be initiated within 24 hours. Refund timelines may vary depending on your financial institution.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to conduct fraud, money laundering, or terrorism financing
  • Interfere with or disrupt the Service or its infrastructure
  • Impersonate any person or entity
  • Use automated systems to access the Service without our written permission
  • Circumvent any usage limits or security measures

9. Intellectual Property

All content, trademarks, logos, and intellectual property associated with the Service are owned by or licensed to DataChill. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal purposes. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, DataChill shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless DataChill, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses arising out of your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Nigeria.

14. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
